PAN Card - Aadhaar Linking - You haven't Linked Your Aadhaar to PAN, Now What?



Linking your Aadhaar Card to PAN is mandated by the I-T department as per the newly introduced Section 139AA of the I-T Act, 1961, since July 1st, 2017. As per the CBDT (Central Bureau of Direct Taxes), any person who possesses a PAN card and Aadhaar Card or Aadhaar Enrolment Id must link the two, irrespective of whether the person files tax returns or not.

But, What if you haven’t linked your Aadhaar Card to PAN before June 30th? 

Well, you can still do it as the June 30th deadline was for those individuals who had to file Income Tax Returns without Aadhaar Card or who had to apply for a PAN card without Aadhaar. If you possess both the government ids then You can still link your Aadhaar Card with PAN on the Income Tax department’s e-filing portal. 

Why Link Aadhaar with PAN card?

According to Supreme Court of India and CBDT, from July 1st, 2017 onwards an individual cannot file I-T return without linking the PAN Card with Aadhaar. Secondly, even to apply for a new PAN card, you must furnish your Aadhaar Card details.

What Section 139AA Says?

'139AA. Quoting of Aadhaar number (1) Every person, who is eligible to obtain Aadhaar number shall, on or after the 1st day of July 2017, quote Aadhaar number -

i) in the application form for allotment of permanent account number
ii) in the return of income

Who is exempted from linking Aadhaar with PAN Card?

The following individuals are exempted from linking Aadhaar with their PAN Card:

i) Individuals residing in the states of Jammu and Kashmir, Assam, and Meghalaya.
ii) If an individual is 80-years-old or above during any time the course of tax year.
iii) Individuals categorized as Non-Resident Indians (NRIs) by the Income Tax Department of India.

What if you do not Link Aadhaar with PAN card even now?

If you do not link your Aadhaar Card with PAN even now then your PAN card will become invalid on a date yet to be notified by the Income Tax Department. It’s not too late yet, you can do it today itself.
