In what comes as a respite to the Delhi and District Cricket
Association (DDCA), the Delhi High Court on Wednesday Nov 18,2015 paved way for them
to host the fourth Test between India and South Africa by directing the
South Delhi Municipal Corporation (SDMC) to issue a provisional
occupancy certificate to the DDCA.
Delhi HC resumed hearing in the case on Wednesday after deferring it a day before, following DDCA's plea after a Delhi government-appointed panel had suggested the BCCI to suspend the local body due to the irregularities in its administration.
However, the relief to the DDCA could be temporary as the HC also appointed Justice Mukul Mudgal to oversee the affairs of Test scheduled to begin December 3.
A bench headed by Justice BD Ahmed observed that it does not want to penalise the players and cricket-loving public by not allowing the DDCA to host the match.
BCCI had given the DDCA time until Nov 17,2015 to get all the necessary clearances.
"Without going into the merit of the matter, it would be appropriate that an observer is appointed to oversee the affairs of the Test match and to ensure that DDCA takes requisite steps for compliance of order. In our view, Justice Mukul Mudgal will be the appropriate person. Accordingly, we request Justice Mudgal to accept the assignment," the bench said.
The bench asked the DDCA to deposit Rs 50 lakh within two weeks with SDMC towards the property tax dues.
During the hearing, advocate Sunil Mittal, appearing for the DDCA, said that the association has been paying the property tax to the civic body and recently it had paid Rs 50 lakh
Senior advocate Dayan Krishnan, appearing for the Delhi government that was not party in the case, intervened and said that something is wrong in the DDCA and the government has the probe report.
DDCA had moved the High Court on Tuesday with a plea seeking a direction to SDMC over issuing a provisional occupancy certificate (POC) to hold the Test at Feroz Shah Kotla stadium. While the match is scheduled to be held from December 3 to 7, DDCA has sought POC from December 1 to 10,2015
After BCCI set a deadline, DDCA had approached Delhi Chief Minister Arvind Kejriwal seeking help to waive the Rs 24 crore entertainment tax. But the CM turned it down and instead ordered a three-member committee to probe complaints of financial irregularities and wrongdoings in the local body.
The panel came out with its report which recommended that, besides suspension by the BCCI, the Delhi government should also bring DDCA under the Right to Information act.
There have always been reports of internal politics in the association which has always kept it in the news for the wrong reasons.
