13 Year Old Aarushi Talwar Murder Case - Ghaziabad

1) On the morning of May 16, 2008, Aarushi daughter of  dentist couple Rajesh and Nupur Talwar, was found murdered in her home in Noida's Jalvayu Vihar.Aarushi used to be locked into her bedroom every night by her mother. The Talwars say this was for safety reasons, since their male domestic help slept inside their home. On the night that she was killed, Aarushi's bedroom keys were found in the hall
2) Records from the night she was killed show that the internet  was switched on at 11.53 pm and switched off at 3 am. The CBI believes she was killed during these hours.
3) The scene of the crime (Aarushi's bedroom) was "heavily dressed up."
4) The court takes the CBI's point that Aarushi's body had been cleaned after she was killed. The agency suggests this was destruction of evidence. The Talwars point out that Aarushi's post-mortem report established a whitish discharge - this proves, they say, that they did not tamper with her body
5)The case was handled first by the Noida Police and then transferred to the CBI after a series of embarrassing lapses that began with the fact that it took an entire day after Aarushi was found dead for the police to walk upto the roof of her home where Hemraj's body was discovered. On that terrace, the police allowed the media free access - reporters and others walked all over a crime scene
6)Dr Talwar was arrested but after two months, he was granted bail when the CBI acknowledged that it had no evidence against him
7) The CBI then refocused on the Talwars as the killers, on the grounds that they were withholding critical information, and may have known why their daughter had been killed
8)  Rajesh and Nupur Talwar - both dentists have undergone at least 5 lie-detector, brain-mapping, and psychological tests," said Nupur. "I do hope that after this, instead of targeting us, they will move on to people who've done it."
9) Nearly three years after she was found with her throat slit in her bedroom, Aarushi Talwar's parents have been accused of murdering the 13-year-old. Rajesh and Nupur Talwar - both dentists - have also been accused of criminal conspiracy and destruction of evidence by  the special CBI Court's order after hearing the arguments on theCBI's closure report.
10) The court has taken cognizance of the CBI report. The court has taken cognizance of offences under Section 302, 201 read with 34 IPC and summoned Dr Rajesh Talwar and Nupur Talwar as accused in the case for February 28 2011.
11) The Talwars' domestic help Hemraj's wife Kumkala has filed an application in the Ghaziabad court alleging that the Talwars murdered her husband. It is a four-page application which will be taken up on April 27.2011.



Nupur Talwar Surrenders in Court - Monday April 30,2012 

 

Nupur Talwar(mother of murdered teenager Aarushi) surrendered  in the court of Special CBI Magistrate Priti Singh following a Supreme Court directive to her to do so in the twin murder case of her 14-year-old daughter and domestic help in Noida four years ago(on the intervening night of May 16-17, 2008)

On April 27,2012 the SC had refused to stay the non-bailable warrant issued against Nupur by the Ghaziabad court.Nupur surrendered today after a Supreme Court bench of justices A K Patnaik and J S Khehar had asked her to approach the trial judge for bail.

Nupur Talwar had faced arrest after the Ghaziabad court had issued non-bailable warrant against her on April 11 following which the CBI had carried out searches at her Delhi premises. 

Nupur Talwar applied for a fresh bail but the Ghaziabad Court rejected Nupur's bail plea and put her under judicial custody in Dasna jail.

 SC Dismisses Review Petition of Talwars - Thursday June 07,2012

 

SC on Thursday dismissed the review petition of Talwars to quash the ongoing trial proceedings against the duo in the Aarushi-Hemraj double murder case, saying it did not find any merit in the petition .

Nupur and her husband Rajesh Talwar have been charged with murder, destruction of evidence and conspiracy in the double murder case that took place in May 2008. 

Rajesh Talwar has also been charged with misleading the investigation in the double murder case.

 SC Orders Bail to Nupur Talwar

 

The Supreme Court on Monday Sep 17,2012 directed the trial court to release Dr. Nupur Talwar on bail on September 25 in the case of the murder of her teenage daughter Aarushi and domestic help Hemraj.

A Bench of Justices A.K. Patnaik and J.S. Khehar disposed of Nupur’s appeal against the order of the Allahabad High Court, which dismissed her bail plea on May 31. She has been in jail from April 30,2012.
At the last hearing on August 13, the Bench asked the CBI to complete recording the evidence of 13 crucial witnesses by September 17,2012.
During the resumed hearing, Additional Solicitor General Siddarth Luthra, appearing for the CBI, said 9 of them had been examined, one witness was dropped and 2 others — a maid and a guard — were not traceable. He opposed bail to Nupur, stating the trial would be completed by December,2012.

Nupur Talwar's counsel, K.V. Viswanathan, however, said there was no allegation that she attempted to influence witnesses. He pointed out that she was never an accused during the course of investigation and that she had cooperated with the CBI.

In its order, the Bench said made it clear to the trial court that it should complete examination of the remaining witnesses by Sep 24,2012. Whether or not the job was over, it should release Nupur on bail the next day

Father Rajesh Talwar hit Aarushi by mistake, says CBI - April 23, 2013


 

CBI investigating officer, AGL Kaul, has deposed before a Ghaziabad court in the Aarushi-Hemraj double murder case. Kaul has claimed that it was Rajesh Talwar, Aarushi's father, who killed the duo. He also said Talwar did not intend to kill Aarushi, but she was killed accidentally. 
CBI investigating officer, AGL Kaul said that Talwar hit Hemraj with a golf club upon discovering him and Aarushi in a 'compromising position'. He also said Aarushi was accidentally hit when Talwar swung the club a second time at Hemraj

CBI investigating officer, AGL Kaul said according to his investigation Rajesh Talwar was awake in his room at 12 midnight whereas the time of murders, according to postmortem report, is between 12-1 AM

The V or U shaped injury on Aarushi's forehead could have been caused by the use of golf stick head," he said. The officer said the noise generated in the process awoke Nupur Talwar who rushed to Aarushi's room. "By the time the injured Hemraj had fallen from the bed. Both checked the pulse of Aarushi and found her near-dead which scared them and planned that the servant should be executed so that no one comes to know about the incident," Kaul said before the court.

The duo wrapped Hemraj's body in a bed-sheet and dragged him to terrace where they slit his throat, covering the body with a cooler panel, Kaul said. He said after coming to the room, they dressed up the crime scene by arranging the bedsheet and toys. They slit Aarushi's throat, to ensure that wounds on Hemraj and their daughter look similar, and Nupur cleaned her private parts, he said.

Giving details of his findings, CBI investigating officer, AGL Kaul said the dentist couple cleaned blood stains, disturbed the router, collected all the clothes which were used to clean blood and also the small sharp edged weapon used in the killing with an intention to dispose them off. "They cleaned the golf stick which was used in the murder and hid it in the loft of Aarushi's bedroom. They locked the door of Aarushi's room from outside. They locked the outermost door from inside and wooden door from outside and entered the flat through Hemraj's room, the door of which opened between these two entry door

Deposing during cross examination in the court, CBI investigating officer, AGL Kaul, who led the second probe team, went into the motive behind the sensational double murder of Aarushi and Hemraj at the Noida residence of dentist couple Rajesh and Nupur Talwar on the intervening night of May 15-16, 2008.
