The Maharashtra cabinet on Thursday Jan 02,2014 partially accepted the report of the judicial commission that probed the Adarsh housing society scam
The decision was made after CM Prithiviraj Chavan held series of sessions with cabinet colleagues and key bureaucrats
During a press conference on Thursday CM Prithiviraj Chavan gave a clean chit to the politicians named in the report
The Report indicted several politicians including 4 former CM's -Ashok Chavan,(Late)Vilasrao Deshmukh,sushilkumar Shinde and Shivajirao Nilangekar Patil
for blatant violations of statutory provisions
CM Prithiviraj Chavan said legal action will be initiated against 25 ineligible members of the housing society.
The Govt accepted the panel's findings that mentioned about the 22 benami flats and also the ineligible
members in the building. It also accepted the indictment of 12 bureaucrats, who had gotten flats in the society for their kin, and former chief minister Ashok Chavan
The bureaucrats who have been found to have violated service rules would face action only under the All India Service Rules, Maharashtra Civil Services Rules and the MRTP Act. Chavan said that since the CBI has already filed a case against five of the bureaucrats, no fresh FIR was needed.
Supreme Court Ruling
"There is a Supreme Court ruling that says that you cannot take multiple actions to prosecute a person for the same case twice. There is already a CBI case going on; we have consulted legal experts and they have said that the state cannot file another FIR in the same case against them," said Chavan.

CBI had charged former CM Ashok Chavan and 12 others for criminal conspiracy, cheating and criminal misconduct under Indian Penal Code and also under Prevention of Corruption Act.
The CBI is at present looking into the 22 benami flats that were mentioned in the action taken report and how these flats were acquired. The CBI is also enquiring if this case has an element of quid pro pro in it
