The final award of the Cauvery Water Disputes Tribunal was notified on Wednesday Feb 20,2013 after a long wait of 6 Years.
It is to noted that the Supreme Court rapped the Centre for delaying the decision and had on February 4,2013 set February 20,2013 as the deadline to issue notification.
The Tribunal’s award will come into effect within 90 days of its notification by the Centre. As per law, the award comes into being after being notified by the Centre through its publication in a gazette
After the issuance of the notification, institutions like the Cauvery
River Authority (CRA) chaired by the Prime Minister and the CMC will
cease to exist.
New organisations like the Cauvery Management Board and the Cauvery
Water Regulation Committee will be constituted which will have
representatives from all the co-basin States, experts in hydrology and
agriculture.
Note
- The Tribunal, comprising chairman Justice N P Singh and members N. S. Rao and Sudhir Narain, in a unanimous award in February, 2007 had determined the total availability of water in the Cauvery basin at 740 thousand million cubic (TMC) feet at the Lower Coleroon Anicut site.
- The proceedings of the Tribunal, set up in June, 1990, went on for more than 16 years
- The Tribunal gave Tamil Nadu 419 TMC of water (as against the demand of 562 TMC); Karnataka 270 TMC (as against its demand of 465 TMC); Kerala 30 TMC and Puducherry 7 TMC.For environmental protection, it had reserved 10 TMC.
TN CM J Jayalalithaa Wednesday termed the gazette
notification of the Cauvery Water Disputes Tribunal's (CWDT) final award
as the culmination of 22 years of struggle and a "great victory for me
and my government".
Jayalalithaa said it was a "big personal achievement in her 30 years of political life".
She said that for the first time in 30 years in politics, she was experiencing "a sense of fulfillment and achievement".
According to her, the state has permanently secured its rights to Cauvery river water and it is the happiest day of her life and of the lives of farmers in the Cauvery delta region.
“I am sure since this has been notified now in the Gazette of India, it becomes binding on Karnataka. And hereafter Karnataka cannot refuse to obey the order of the Tribunal. So I hope in future there will be no problem and when there is abundant water, we hope that we will receive our due share and when there is distress we will abide by the directions given in the final order, final award of the Tribunal as to how distress should be shared,” she said
