CWG Scam

 


 

The Delhi HC on Thursday Jan 19,2012 granted bail to former CWG OC Chief Suresh Kalmadi(Congress MP from Pune) on a surety of Rs 5 lakh after nine months(arrested on April 25,2011 u/s 120 B and 420 (criminal conspiracy and cheating) of the IPC  in the CWG Time Scoring Equipment Scam) who is an accused in the case pertaining to the mega-sporting event held in New Delhi in 2010.

 Scam Details 

Kalmadi was accused of handing out a Rs. 141-crore contract to Swiss Timing for its timing equipment - the deal was inflated by Rs. 95 crores. An official recommended the disqualification of a Swedish company, allegedly at Mr Kalmadi's behest, leaving only the Swiss firm in the fray. The Central Bureau of Investigation, which probed the case, filed a chargesheet against Kalmadi in May 2011.

The HC also granted bail to former director general of CWG VK Verma.

Kalmadi, Verma and nine others have been accused of allegedly awarding a contract to a Swiss firm to install a Timing-Scoring-Result (TSR) system for the Games at an exorbitant rate, causing a loss of over Rs 90 crore to the state exchequer.  

 

Kalmadi had earlier moved the High Court seeking bail citing the Supreme Court's judgement in 2G spectrum case and said it has been held that "bail is rule and jail is exception".
The CBI, however, opposed the bail pleas of Kalmadi and Verma saying the trial is to begin soon and would be held on a day-to-day basis.
The CBI alleged Kalmadi was the key accused in the case.

Delhi Court Orders Framing of Charges -Friday Dec 21,2012

A Delhi court on Friday Dec 21,2012 ordered framing of charges for offences of forgery, cheating and conspiracy in a Games-related graft case against -

4)Surjit Lal, Joint Director General (Sports) 

5)A S V Prasad and 

6)Treasurer M Jayachandran

7)P D Arya and A K Madan of Faridabad-based Gem International

8)A K Reddy of Hyderabad-based AKR Constructions

Special CBI Judge Talwant Singh passed the order on framing of charges against Kalmadi, former OC Secretary General Lalit Bhanot and nine others for illegally awarding a contract to Swiss firm, Swiss Timing Omega, causing huge loss to the exchequer.

“Charges under section 120B (criminal conspiracy), 201 (destruction of evidence), 420 (cheating), 467, 468, 471 (relating to forgery), 506 (criminal intimidation) of the IPC and section 13(1)(d) read with section 13(2) (criminal misconduct by public servants) of the PC Act is ordered to be framed against all the accused,” the court said. 

The court said “prima facie” charges of cheating, forgery, criminal conspiracy and for offences under the provisions of the Prevention of Corruption Act are made out against eight accused persons and three companies.
