November 23, 2011: Supreme Court grants bail to five telecom executives - Unitech Wireless' former MD Sanjay Chandra, Swan Telecom's Director Vinod Goenka and Reliance Anil Dhirubhai Ambani Group's executives Hari Nair, Gautam Doshi and Surendra Pipara. They were charged with criminal conspiracy cause criminal breach of trust by a public servant.

November 28, 2011: Delhi High Court grants bail to Kanimozhi, Sharad Kumar, Karim Morani, Asif Balwa and Rajeev Agarwal; reserves bail plea of Siddharth Behura.

December 8, 2011:  Subramanian Swamy allowed to testify in support of his private complaint seeking prosecution of Union Home Minister P Chidambaram in the 2G case by a Delhi court.

January 7, 2012: 
Subramanian Swamy submits certified copies of documents and concludes his arguments. Court lists Swamy's application for arguements on January 21.

January 21, 2012:
Delhi court reserves its order for February 4 on Subramanian Swamy's plea seeking prosecution of Union Home Minister P Chidambaram in the 2G scam case.

February 2, 2012:
The Supreme Court will deliver three important verdicts on the telecom scam. Justices GS Singhvi and AK Ganguly will announce whether Home Minister P Chidambaram should be investigated by the CBI, which is handling the telecom or 2G scam.
February 2, 2012: SC refuses to ask CBI to probe role of Chidambaram in 2G case and leaves it to the Special court to decide the matter.
February 4, 2012: Special court dismisses Swamy's plea to make Chidambaram a co-accused.
February 23, 2012: Subramanian Swamy moves SC against trial court order on Chidambaram. NGO, Centre for Public Interest Litigation also files application seeking probe against Chidambaram.
March 1, 2012: Plea against Chidambaram and Law Minister Salman Khurshid for their alleged role in the 2G spectrum scam is listed for hearing in the SC.
April 4, 2012: SC begins hearing plea against Chidambaram.
April 24, 2012: SC reserves order on the maintainability of the plea for probe against Chidambaram in the 2G spectrum case.
August 24, 2012: SC dismisses plea for probe against Chidambaram in the 2G case, says no prima facie material to show that Chidambaram got pecuniary benefits








Trial in the 2G spectrum allocation scam began in the court of Special Central Bureau of Investigation Judge OP Saini in New Delhi on Friday 11.11.2011

Reliance Capital's Assistant Vice President Anand Subramaniam was the first to be examined by the CBI as a prosecution witness.
In all 150 witnesses are to be examined in the trial that is being monitored by the Supreme Court.The CBI, in its first list, had submitted names of 28 persons to be examined as prosecution witnesses before the court.
In the first list, out of 28, 11 witnesses are from Reliance ADAG which suggests that the agency wants to deal first with the charges against accused firms Reliance Telecom Ltd and Shahid Usman Balwa promoted Swan Telecom.
Reliance Telecom Ltd has been put on trial by the court which said Swan Telecom Pvt Ltd was "just a mask" for RTL.

Charges against the accused in 2G case

 

 

1)A Raja(Former Telecom Minister)has been charged with criminal conspiracy for criminal breach of trust under IPC Section 409, cheating, forgery, accepting bribe/illegal gratification and misuse of office.The maximum punishment if convicted for criminal breach of trust is life term while the minimum punishment is seven years in prison. 

 

2)DMK MP Kanimozhi charged with abetment of illegal gratification, criminal conspiracy for criminal breach of trust, cheating, forgery, accepting bribe/illegal gratification and misuse of office.  

 

 

3) Shahid Balwa(DB Realty promoter)  charged with criminal conspiracy, cheating, abetment of illegal gratification and forgery 

 

4)Vinod Goenka(DB Realty M.D) charged with criminal conspiracy, cheating, abetment of illegal gratification and forgery

 

5)Sanjay Chandra(Unitech Ltd's MD) charged with criminal conspiracy for criminal breach of trust, cheating, forgery, accepting bribe/illegal gratification and misuse of office.

 

 

6)Gautam Doshi(Reliance ADAG Managing Director) charged with cheating, abetment to cheating, criminal conspiracy, criminal conspiracy for criminal breach of trust, cheating, forgery, accepting bribe/illegal gratification and misuse of office 

 

7) Surendra Pipara(Reliance ADAG Group President) charged with cheating, abetment to cheating, criminal conspiracy, criminal conspiracy for criminal breach of trust, cheating, forgery, accepting bribe/illegal gratification and misuse of office 

 

8)Hari Nair(Reliance ADAG Senior Vice President)charged with cheating, abetment to cheating, criminal conspiracy, criminal conspiracy for criminal breach of trust, cheating, forgery, accepting bribe/illegal gratification and misuse of office

13)Siddharth Behura(Former Telecom Secretary) charged with criminal conspiracy to cheat, forge documents and criminal breach of trust and misuse of office. 

14)RK Chandolia(Raja's former private secretary) charged criminal conspiracy for criminal breach of trust, cheating, forgery, accepting bribe/illegal gratification and misuse of office.


SC Gives Bail to 5 Corporate Executives - Nov 23,2011

A Bench comprising justices G S Singhvi and H L Dattu directed the release of the five corporate Executives in jail since April 20,2011 –

DMK MP Kanimozhi on bail - Nov 28,2011

                          
 


The Delhi High Court had granted bail on Monday Nov 28,2011 to DMK MP Kanimozhi and four others.(Cineyug founder Karim Morani, Kalaignar TV's MD Sharath Kumar, Kusegaon directors Asif Balwa and Rajeev Agarwal.)However,Kanimozhi had to spend one night extra in prison as orders for her release from Tihar was issued by the special CBI court only on Tuesday evening Nov 29,2011.Dressed in a pink salwaar-kameez, Kanimozhi emerged from Tihar Jail at 7:30after morethan 6 months in Tihar Jail(in judicial custody since May 20,2011)


While ordering the release of the five accused Justice VK Shali of the Delhi High Court observed that they have been granted bail as the CBI had not opposed their bail applications

DMK MP Kanimozhi arrives in Chennai on Saturday December 03,2011

DMK MP Kanimozhi left Delhi for Chennai at around 9:30 this morning Dec 03,2011 and  is scheduled to reach Chennai at 1 pm."It is a very happy feeling for me to be going to Chennai. But more than the bail, it is important for me and the others to prove our innocence," she said while leaving for the airport.

DMK MP Kanimozh reached Chennai at around 1:30 pm(afternoon) and Karunanidhi received her at the airport.Apart from Karunanidhi, MK Stalin, his sister and his mother - and hundreds of DMK supporters were also present at the airport to welcome Kanimozhi.





Subramanian Swamy deposes as witness, seeks Chidambaram's prosecution - Dec 17,2011


Testifying as a witness before Special CBI Judge O P Saini in support of his private complaint seeking prosecution of Chidambaram, Swamy said Raja could not be held guilty "alone" of the charges that he fixed the price of spectrum licence in 2008 at the prevailing rates of 2001.(Court had on December 8 allowed Swamy to testify himself in support of his private complaint seeking Chidambaram's prosecution in the case)
Swamy said that the Prime Minister, in his statement made on the floor of Rajya Sabha on February 24, 2011, had said that pricing of spectrum was taken on the basis of a cabinet decision of 2003 which specifically said that the issue would be determined by the Ministry of Finance and Department of Telecommunication.

A Raja's Former Additional Personal Secretary Aseervatham Achary in his testimony before the Court on Monday Dec 19,2011 said that -
  • DMK MP Kanimozhi was a frequent visitor to Raja's office and residence when he was the IT minister.
  • Unitech's Sanjay Chandra and DB Group's Shahid Balwa and Vinod Goenka were known to A Raja from his days as environment minister.Sanjay Chandra, Shahid Balwa and Vinod Goenka used to meet a Raja when he was environment minister in relation to environmental clearance required for big real estate projects in which these companies were involved.
  • Raja, Kanimozji, Shahid Balwa, Vinod Goenka and Sanjay Chandra were all part of the 2G conspiracy.


Subramanian Swamy completes arguments against P.chidambaram,Special CBI Court has reserved its order on the arguments for February 4,2012

2G petitioner and Janata Party President Subramanian Swamy completed his arguments against Home Minister P Chidambaram in a Delhi court on Saturday Jan 21,2012.
After completing his arguments, Swamy said, "I have presented the minutes of a meeting between A Raja and Chidambaram in which Chidambaram has said that 6.2 mhz spectrum should be given for free with license." Also presented the MHA note to finance ministry, which said Swan and Unitech, both were influenced by the ISI and also claimwed that Balwa was Dawood's man.
Swamy told the court that he wanted to make Chidambaram a co-accused in the 2G scam as  Chidambaram colluded with Raja on matters related to fixing of the spectrum, allowing the dilution of shares of two companies Unitech and Swan.
Swamy claimed that Chidambaram was involved in criminal breach of trust and had compromised national security.

The court has reserved its order on the arguments for February 4,2012 said special CBI judge O.P. Saini.


Supreme Court Cancels all 122 2G licences given by A Raja

 Declaring the allocation of 2G spectrum as “illegal” and an example of the arbitrary exercise of power, the Supreme Court on Thursday Feb 02,2012 cancelled all 122 telecom licences allotted on or after January 10, 2008 to 11 companies during the tenure of the former telecom minister, A. Raja

 

"The licences granted to the private respondents (companies) on or after Jan 10, 2008... and subsequent allocation of spectrum to the licensees are declared illegal and are quashed," said a bench comprising Justices GS Singhvi and AK Ganguly. on Thursday Feb 02,2012.

While cancelling the licences the Supreme Court ruled that 85 out of the 122 licences were outside the eligibility criteria for allocation. The apex court said that the 122 licences for 2G spectrum were granted in an arbitrary and unconstitutional manner.  

The licences cancelled include -


21 of Videocon, 

22 of Unitech Wireless Ltd (Uninor),

9 of Idea,

 21 of Loop, 

6 of S-Tel,

 21 of Sistema, 

3 of Tata,

 13 of Swan and

2 of Allianz.

 The licences, which were allotted by former telecom minister A Raja, will be cancelled in four months from now and the Telecom Regulatory Authority of India (TRAI) must go in for a fresh issue of licences during this period, the apex court observed.

A penalty of Rs 5 crore has been imposed on Unitech Wireless Ltd (Uninor), Swan Telecom and Tata Telecom. A penalty of Rs 50 lakh has also been imposed on Loop, S-Tel, Allianz and Sistema Shyam.

In another critical judgement, the Supreme Court referred the matter of whether the role of former finance minister P Chidambaram should be investigated back to the trial court of Justice OP Saini. This represents a breather for Chidambaram, but it does not lift the cloud over him.
The apex court also refused to direct the CBI to probe the alleged role of Chidambaram in the case and asked trial court to decide on the Home Minister within two weeks.

2G court rejects Swamy's plea,Relief for P Chidambaram

 

In a huge relief for Union Home Minister P Chidambaram, a Delhi court on Saturday Feb 04,2012 dismissed a petition by Janata Party President Subramanian Swamy seeking to make him a co-accused in the 2G spectrum case.
"Your prayer to summon Chidambaram as an accused is dismissed," Special Judge O P Saini said on Swamy's petition reading out from his much-awaited judgement.
The court said it will commence the hearing on the complaint filed by Swamy in which he had made further allegations against former Telecom Minister A Raja without making Chidambaram an accused from March 17.2012.

Tata Teleservices filed an appeal in the Supreme Court against the cancellations of its licences in three circles



 

Loop Seeks Refund of License Fee Along with Interest

Loop Telecom, one of the several firms whose licence was cancelled by the Supreme Court early this month, has written to Prime Minister Manmohan Singh saying it will surrender the licence if the government refunds Rs 1,454 crore fee along with interest.
"We will surrender the licence, against the DoT making a refund of licence fee of Rs 1,454 crore with interest. All our performance and financial bank guarantees may be released," Managing Director and CEO Sandip Basu wrote to the Prime Minister on February 17,2012. 



Govt. Files Review Petition - Friday March 2,2012
The government has not challenged the cancellation of 122 licenses directly, but it has challenged one of the bases of this cancellation- the court's observation that the first come first serve (FCFS) policy was flawed.

The government's review petition today said policy involves the balancing of "different values and considerations." This job, it stressed, belongs to the executive and "it is not permissible for the court to take this exercise upon itself... both for the reason that it is not its role to do so and it does not have the expertise to do so."


Sistema files review petition in SC - Friday March 2,2012

Sistema Shyam Teleservices (SSTL), the joint venture between Russia's Sistema and India-based Shyam Group on Friday filed a petition in the SC  seeking a review of its order that quashed the firm's 21 licences issued in 2008.
"SSTL believes that the Supreme Court in its judgment has not considered several relevant submissions made by SSTL which were specific and unique to its case," the company said in a statement.

The company said it was being "unfairly penalized for acting in good faith and in reliance on the appropriateness of the procedures established by India's telecommunications authorities."


A Raja asks SC to review cancellation of 122 licences

Former Telecom Minister A Raja has asked the Supreme Court to review its decision that cancelled 122 mobile network licences issued by him since the principles of natural justice were not followed because he was not allowed to present his case to the Supreme Court.




Kanimozhi challenges framing of charges in 2G case

DMK Rajya Sabha MP Kanimozhi on Friday March 23,2012 moved the Delhi High Court, challenging the framing of charges against her in the 2G spectrum allocation case. Her petition, seeking quashing of the allegations and her discharge in the case, is likely to come up for hearing next week. 

Govt withdraws Review Petition from SC

The Govt on Tuesday May 08,2012 decided to withdraw its petition seeking review of the Supreme Court’s verdict cancelling 122 2G spectrum licenses granted to various telecom companies during A Raja’s tenure as telecom minister.

Two days before the scheduled hearing of the petition by a special bench of justice GS SInghvi and justice KS Radhakrishnan on the limited question of auctioning of natural resources, the telecom department circulated a letter informing the withdrawal.

 

SC raps Centre over 2G review plea

The SC on Thursday May 10,2012 allowed Govt to withdraw its petition seeking review of the 2G judgement after rapping it for circulating a letter on its intention to various parties linked to the matter.

A letter was circulated on May 8, 2012 to the parties linked to the matter, saying an application would be moved on May 10, 2012 for withdrawing the petition seeking review of the February 2, 2012 judgement which had held the first-come-first-serve policy as unconstitutional.

The Centre’s letter circulated to various parties said, “In view of the fact that only limited notice has been issued, the petitioners do not want to press the review petition and will be praying for withdrawal of the review petition.”

The SC granted withdrawal of the review petition on the “oral request” made by Additional Solicitor-General Indira Jaising.

The Govt’s plea for withdrawal of the review petition was opposed by -

Prashant Bhushan appearing for the NGO, Centre for Public Interest Litigation, on whose petition and others’ CBI probe was ordered in the 2G spectrum scam

Janata Party president Subramanian Swamy has also opposed the withdrawal of the review petition

 

CBI Court Reserves Order on Raja’s Bail Plea

Raja had filed the application soon after former telecom secretary Siddharth Behura, who was arrested along with him on February 2 last year, was granted bail by the Supreme Court

"All the individual accused persons in this case, except the petitioner, have been released on bail .... The petitioner is entitled to bail on the grounds of parity," Raja had said

The CBI on Friday opposed in a Delhi court the bail plea of former Telecom Minister A Raja, arrested for his alleged role in the 2G spectrum allocation case on February 2 last year, saying there is a new allegation that he got Rs 200 crores as bribe and it is being probed.
CBI prosecutor A. K. Singh opposed Mr. Raja’s bail plea saying there is a new allegation that he has received Rs 200 crores as bribe and this is being investigated.

The court reserved its order on Mr. Raja’s bail plea for May 15,2012 after hearing the arguments from Mr. Raja’s counsel and that of the CBI.

A Raja gets bail, walks out of Tihar Jail

 

After spending nearly 15 months in the Tihar Central Jail former Telecom Minister A. Raja, facing trial in the 2G spectrum allocation case, was granted bail by a special CBI court on Tuesday May 15,2012(Raja was arrested by the CBI on February 2, 2011 and he was in its custody till Feb 17 and after that he has been in judicial custody)

 

The court granted bail on Mr. Raja furnishing a personal bond of Rs.20 lakh with two sureties for a like amount. Among the conditions that Mr. Saini imposed on him were that he should not visit Tamil Nadu or the Telecom Department without the court's permission.
The court also forbade him from “directly or indirectly making any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts as may be necessary to the court or to any other authority.”

Court allows Raja to visit Tamil Nadu

A Raja had sought court’s permission also on the ground that the trial proceedings would not be undertaken from June 9 to June 30 owing to summer vacation and Special CBI Judge O.P. Saini allowed the plea to visit his home State Tamil Nadu between June 8 and June 30 on Wednesday June 06,2012.

 SC says no evidence against P Chidambaram, dismisses Subramanian Swamy's plea

 

The Supreme Court (SC) on Friday Aug 24,2012 gave a clean chit to Finance Minister P Chidambaram in the 2G spectrum allocation scam. The apex court dismissed Janata Party chief Subramanian Swamy's plea and said that no case is made out against Chidambaram

"There is no prima facie material to show that P Chidambaram got pecuniary benefits. There is no material evidence available to show that Chidambaram abused his position. No case is made out against P Chidambaram and the special leave petition filed against the judgement of the special CBI court is not liable to be entertained. Accordingly, the SLP is rejected," the bench of justices GS Singhvi and KS Radhakrishnan said.  

The SC judgement read, "Criminal conspiracy cannot be inferred merely because Chidambaram met Raja and DoT officials on spectrum pricing. Poor management in allocation of spectrum cannot be said to be product of criminal conspiracy."  


NOTE - This is the second time a judicial relief has come for Chidambaram after a Delhi court on February 4 this year had dismissed a plea of a co-accused in the 2G case. 

Special CBI Judge OP Saini had held that Chidambaram had not indulged in any criminal conspiracy or derived any pecuniary advantage in the decisions taken with Raja.
Giving a clean chit to the Finance Minister in the allocation of 2G spectrum in 2008, Saini had said Chidambaram was party to only two decisions - keeping spectrum prices at 2001 level and dilution of equity by two companies - which "are not per se criminal".

 Comments on the SC Judgement
Commenting on the judgement, Union Minister for Corporate Affairs Veerappa Moily said, "Their (Opposition) attack on him was unwarranted, damaging a person's reputation and they should now admit their mistake."
Simultaneously, Congress spokesperson Manish Tewari said that after this judgement it is very clear that BJP has no case. "BJP has no legs to stand upon. Nation can't be held hostage," said Tewari.
Union Minister Ambika Soni said, "It is a slap on the Opposition's face. The government has said it repeatedly that there is no ground or evidence for this petition."
Criminal lawyer Majid Memon, too, said, "This will hopefully bring an end to all the political speculation about involvement of more people in this case."

Subramanian Swamy called the Supreme Court decision a a bad judgement. "I did not even talk about any conspiracy. Neither did I mention of any conspiracy. I didn't have to prove criminal intent which I did not, I only said there is a national loss."

He also said that the judgement is not based on his argument. "The Supreme Court's judgement is based on something I did not argue."



 

 SC Extends Deadline for 2G Auction to Jan 11,2013

 Note

SC while quashing 123 licences in February 2012, had given four months for their fresh auction which was extended till August 31,2012.

The Supreme Court on Monday Aug 27,2012 directed the Central Government to complete fresh auction of cancelled 122 2G spectrum licences by January 11, 2013 and warned that failure to meet the deadline would invite "contempt" action against erring officials with "exemplary" cost.

A bench of justices G S Singhvi and K S Radhakrishnan, which extended the August 31, 2012 deadline for completing the auction process, made it clear that no court in the country will entertain any plea on this issue of 2G spectrum.
It said existing licencees of the 2G spectrum, who had to shut down the operation by Sep 7,2012 are "entitled to operate up to January 18 next year." The bench, which expressed its displeasure against the
Centre for not mentioning the "outer limit" for completing the auction process, said "unless it will fix the outer limit the auction process will never happen" and "it is also the fact of the matter that they (Centre) have not complied with the February 2 judgement."

 

 

 

 








DoT said it will issue a notice inviting applications Sep 28,2012 and the last date of submission of application will be Oct 19,2012

The final list of bidders will be announced Nov 6,2012.This will be followed by a mock auction November 7 and 8 and thereafter the e-auction of 1800 MHz band will take place Nov 12,2012.
