Aam Aadmi Party MLA Pawan Sharma sentenced to 18 months in jail on charges of “causing death by negligence” Monday Aug 29,2016

A DELHI court has sentenced Aam Aadmi Party legislator Pawan Sharma to 18 months in jail on charges of “causing death by negligence” of a factory worker in 2009.

On August 29, 2016, Metropolitan Magistrate Virender Singh sentenced the Adarsh Nagar MLA to rigorous imprisonment for 18 months, besides sentencing him to rigorous imprisonment for six months for “negligent conduct with respect to machinery”.

The two jail terms will run concurrently, said the court.

The court also slapped a fine of Rs 1 lakh, to be paid to the Delhi State Legal Services Authority (DLSA) within 30 days from the date of the order. While imposing the fine, the court observed that the wife and daughters of the victim had remained untraceable.

“The wife as well as the daughters of the deceased Ram Kumar can claim the aforesaid compensation amount from the DLSA in addition to some other suitable compensation as and when they want,”said the court. Keeping in mind that the quantum of punishment was less than three years, the court granted bail to Sharma on a bail bond and a surety bond of Rs 20,000 each.

The case against Sharma was registered on August 5, 2009, at north Delhi’s Samaypur Badli police station. The prosecution had claimed that Ram Kumar, a worker employed in Sharma’s factory, got injured and subsequently died due to negligence on the part of the factory authorities.

Seeking leniency for Sharma, the defence had argued that he did not have a criminal record and was a responsible citizen of society. The court, however, observed, “It is also not beyond the sight of this court that in the present case, a 40-year-old male died due to the negligent act of the convict.”
