Rajiv Gandhi Assassination Case - Supreme Court of India (SCI) Asks CBI for Time-frame to Complete Probe Monday May 01,2017

The larger conspiracy behind the assassination of former Prime Minister Rajiv Gandhi "has to be investigated", the Supreme Court of India (SCI) said on Monday May 01,2017 and asked the CBI to give a time-frame for completing the detailed probe.
The SCI was hearing a plea on the matter by A G Perarivalan, one of the convicts whose death sentence was commuted to life term in the assassination case.
He has alleged that neither the CBI's special investigation team, nor the Multi Disciplinary Monitoring Agency (MDMA) headed by it, had proceeded with the probe in a proper perspective to bring the accused to book, as several top people were involved in it.
"This has to be investigated. May be not at his (petitioner's) instance, but this needs investigation," a bench, comprising Justices Ranjan Gogoi and Navin Sinha, said.
The bench asked the CBI to file a detailed investigation report along with a time-frame within which the probe would be completed. It also directed the agency to indicate the legal hurdles, if any, and the steps taken to overcome these issues.
During the hearing, Additional Solicitor General Maninder Singh told the apex court that investigation was going on and it would take some time as some accused were absconding.
He said the matter would require extradition proceedings since some of the absconding accused were out of India. To this, the bench asked "is it the stand of the government that as on today, investigation into these aspects can go on?"
Responding to the query, Singh said "yes" but it would take some time.
He argued that the CBI has already filed a counter affidavit in the matter and that Perarivalan's conviction has been upheld by the apex court, while the probe into several aspects of the case was going on.
"With or without him (Perarivalan), this matter has to be investigated. What benefits he may get out of the investigation will be seen later," the bench said and fixed the matter for hearing on August 16.
"We will have to be satisfied that the time-frame needed by you is justified or not," the bench said.
The SCI had earlier sought the response of the Centre and the CBI on the plea which has alleged that CBI did not probe the conspiracy behind the killing of Rajiv Gandhi in 1991 despite an order from a TADA court in Chennai.
The SCI had on Febraury 18, 2014 commuted the death sentence of Perarivalan to life imprisonment, along with two other condemned prisoners -- Santhan and Murugan -- on grounds of a delay of 11 years in deciding their mercy plea by the Centre.
Perarivalan had earlier sought the case dairies pertaining to CBI and MDMA, which had probed the matter. He had also referred to the inquiry report of the Justice Jain Commission that had probed the conspiracy aspect of the assassinaation and which had formed the basis for the TADA court's order for a further probe to identify the role of individuals to uncover the larger conspiracy in the murder.
The convict had alleged that the CBI and the MDMA, which were entrusted with the task to probe the facts, have not done their work properly.
"The grievance of the petitioner is that the designated TADA Court was monitoring the pending investigation on paper only, but without knowing the actual facts of the investigation being conducted by CBI (MDMA) for the last about
17 years.
"The TADA Court merely collected sealed covers cluelessly, that too in-chambers vide in-camera proceedings, from the investigating agency every three months, once without even opening the said covers for so many years," the plea has claimed.
Note
Rajiv Gandhi was assassinated on the night of May 21, 1991 at Sriperumbudur in Tamil Nadu by a suicide bomber at an election rally.

Department of Telecom Launches Tarang Sanchar, a Web Portal For EMF Emission Compliance Information Tuesday May 02,2017

The Department of Telecom today Tuesday May 02,2017 launched a portal that will allow people to track radiation emitted from mobile towers within a locality and check their compliance with the stipulated norms.

Launching the ‘Tarang Sanchar’ web portal, Telecom Minister Manoj Sinha hoped the site will help in clearing “myths and misconceptions” about mobile towers and emissions from them.

He said the portal will empower consumers to know, at the click of the mouse, about the towers working in a particular area and whether they are compliant to the Electromagnetic field (EMF) emission norms defined by the government.
The timing of the launch coincides with the recent SC order on deactivation of a mobile tower in Gwalior on the plea of a 42-year-old cancer patient.
The order had intensified the debate on the impact of radiation from mobile phone towers on health. However, the government has maintained that the mobile tower emissions rules in India are 10times more stringent than the global norms.

Malta Prime Minister Joseph Muscat calls snap general election

Malta's Prime Minister Joseph Muscat has called a snap general election for June 03,2017 a year before his term ends.
The opposition has been calling for his resignation over allegations that his wife owned an offshore company in Panama.
Joseph Muscat and his wife, Michelle, deny the claims. A magisterial inquiry is under way.
He said "truth is on my side" but that he wanted to protect Malta from uncertainty.
The current scandal erupted earlier this month when the blogger Daphne Caruna Galizia made the claims, which she based on documents from the so-called Panama Papers, a leak of millions of files from the offshore law firm Mossack Fonseca.
"Everybody knows about the attacks made in the past few days on me and my family. I have nothing to fear because truth is on my side and I am clean," Mr Muscat said on Monday.
"My duty, however, is not just to protect myself but also to safeguard my country... We cannot allow uncertainty to slow the rhythm of Malta's economic miracle," he said.

Infrastructure Investment Trusts (Inv-IT) - All You Need To Know

Infrastructure Investment Trusts (Inv-IT) are all set to see the light of the day with IRB Infrastructure Developers launching its public offer this week. Infrastructure companies believe that these instruments will help them shed debt and raise some funds. But the infrastructure sector comes attached with all kinds of risk; so these instruments are restricted to only those with deep pockets and the ability to take risk.
What is it?
Inv-ITs help companies monetise healthy infrastructure assets and provide a channel for investors to buy a stake in infrastructure projects. The money raised through the fund can be used only to buy infrastructure assets, both in the form of equity as well as debt. But the catch is, that of the total assets bought, the fund is required to invest at least 80 per cent in revenue generating infrastructure asset. The rest can be invested in under-construction infrastructure asset or securities of infrastructure companies.
So, how are the investors benefited? The trust distributes a proportion (in the case of IRB Inv-IT fund, it is 90 per cent) of the income generated from these projects to investors. So the toll revenue earned by the road projects and other revenue streams including interest and dividend earned from other investments, will have to be distributed.
The Inv-IT is managed by an investment manager. Since these instruments carry higher risk, the entry barrier for investment is high. For instance, minimum investment in the primary offer of IRB Inv-IT is ₹10 lakh while the lot size in the secondary market is ₹5 lakh. The sponsor is mandated to hold minimum 15 per cent of the equity for a minimum period of three years from the date of issue.
Why is it important?
If this model is well accepted by the market, it will provide relief, both to developers of infrastructure project as well as to banks. Why so? An infrastructure project is plagued by myriad risks at every stage of construction.
During the initial stages of project construction, land acquisition and environment regulations pose risks to project materialisation. Once the asset is constructed, the risk of projected revenue materialising causes considerable anxiety both to equity and debt holders. For instance, take the case of poor traffic flow and toll collection in many road projects. When revenue does not materialise as expected, the project promoters and lenders are often caught in a logjam.
Through Inv-ITs, promoters of infrastructure projects can sell some of their stable, revenue generating projects. The funds thus raised can be used to reduce debt and invest in their other projects that could be stuck due to lack of funds. As the cash flow of the companies improves, their debt servicing ability will also improve, providing relief to banks.
Why should I care?
If you are a high net worth individual (HNI) with a penchant for risk, you can definitely look into this option to invest for the long term. The market regulator, SEBI, has taken enough measures to ensure that investors are not taken for a ride by promoters and that there will be sufficient cash-flow from the assets to enable a decent pay-out; far above the risk-free rate of interest.
But once you invest, do keep an eye on the investment manager. Because, the overall risk and return profile depends on the kind of projects he invests in

2017 Anantnag Parliament By-Election - Election Commission of India(ECI) Anantnag LS bypoll scheduled to be held on May 25,2017

The by-elections to the Anantnag Parliamentary constituency, scheduled for May 25, 2017 have been cancelled by the Election Commission.
In an order issued post-midnight on Monday, the Commission said that it decided on this course of action based on inputs received from various sources including the State Administration, Chief Election Officer, Jammu and Kashmir, Director General of Police, representatives of various political parties and candidates contesting the by-polls.
The Commission received various reports of violence including an April 20 report from the Jammu and Kashmir Chief Secretary which said that during the last few days the number of incidents of burning of schools/panchayat ghars which were designated polling stations for the Anantnag by-elections and attacks on political personalities had taken place.
The report also expressed apprehensions that if polls were held on May 25 Anantnag Parliamentary constituency might witness “large scale violence but can also result in even lower voter turnout.” The communication added that the State Government was of the considered view that the polls be deferred at least till the end of October.
The decision to cancel the polls also comes as both Ramzan and also the Amarnath yatra which falls in Anantnag District fall between May and August and the State Administration will be busy with these two festivals. Besides, the tourist season is also approaching. The tourist trade affects the business and commercial activity in the State.
“The enforcement of the Model Code of Conduct covering four important districts of the state during this peak period of festivity and tourism would also adversely affect the daily lives of the people of the area. Therefore deferring the elections further does not seem a feasible option,” the Commission said in its order.
Taking note of the fact that no improvement in the law and order situation is in sight the Commission was of the opinion that this was not an opportune time to have the by-polls in Anantnag Parliamentary constituency. “In view of the prevailing ground situation and non-availability of sufficient security forces, the Commission is of the considered view that peaceful, free and fair polls is not feasible on May 25 as scheduled at present,’’ the Commission’s order says.
The notification for conducting the elections was issued on March 9 with April 12 being the initial date for the by-polls. But following incidents of violence the polls had been deferred to May 25.
